CloseSimple SMS Messaging Privacy Policy

This CloseSimple SMS Messaging Privacy Policy (the "Policy") applies to the CloseSimple SMS Messaging Service (the “Service”) provided by CloseSimple on behalf of our Real Estate Title and Escrow business clients (each a "Brand").
The Policy outlines how we collect, use, and protect your information in connection with our Service, which is used to provide transactional updates on the behalf of the Brand with which you are transacting. By opting into our Service, you agree to the terms of this Policy.

This Policy is incorporated by reference into and should be read in conjunction with our SMS Messaging Terms and Conditions.
Service Description
Our Service provides critical, non-marketing, transactional updates and reminders regarding the status of your real estate closing, including important dates, document requirements, and confirmation of key milestones at the direction of the Brand.
Compliance
This Service is designed to comply with CTIA (Cellular Telecommunications Industry Association) best practices and 10DLC (10-Digit Long Code) requirements for A2P (Application-to-Person) messaging.
Information We Collect
We collect the following information on the behalf of the Brand in connection with your participation in the Service:
- Mobile Phone Number: Used solely for the purpose of sending you transactional SMS messages.
- Opt-in/Opt-out Status: Records your consent status for the Service.
- Message Content and Timestamp: Details of messages sent and the time they were sent, necessary for logging and service delivery.
Use of Information
The information collected to support the Service on the behalf of the Brand is used solely for the following purposes:
- To facilitate the delivery of transactional updates and alerts related to your real estate closing.
- To maintain an accurate record of your consent (opt-in/opt-out).
- To comply with legal and regulatory requirements.
Data Sharing and Transfer
- Data Transfer to Service Providers
CloseSimple transfers your mobile phone number and messaging preferences to our downstream telecommunications providers and mobile carriers solely as necessary to transmit the SMS messages you have requested at the direction of the Brand. These providers are contractually prohibited from using your information for any purpose other than message delivery. - Sharing with Our Clients (The Brand)
- As a technology provider, CloseSimple shares your opt-in status and message delivery history with the specific Brand that you are working with. This ensures your service team is informed of your communication preferences.
- No Sharing for Marketing or Affiliate Purposes
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. We do not sell, rent, lease, or share for marketing or promotional purposes text messaging originator opt-in data or consent. - Legal and Compliance Transfers
We may only otherwise disclose your information if required by law, such as to comply with a subpoena or similar legal process, or when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.
Policy Changes
We reserve the right to modify this Policy at any time. Any changes will become effective immediately upon posting the revised Policy. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes. We may also contact you by email using the email that you have provided to us.
